Court of Appeal Upholds Firm’s $4.5M Verdict in Sexual Abuse Case

U-T San Diego called upon Dave Ring to discuss the state appellate court’s rejection of an appeal by the Carlsbad Unified School District, upholding the firm’s $4.5 million jury award against the school district and its teacher for failure to protect students from the preying teacher.

The district argued that the claims were not valid because the families missed the deadline to file. The Fourth District Court of Appeal found the argument flawed as the district actively discouraged parents of the molested children from discussing the case with anyone other than school officials and law enforcement in order to avoid damage to the teacher’s criminal prosecution.

“It took a long time to get here,” said Mr. Ring. “This happened back in 2007. I’m happy for those parents and the children that they can finally put this behind them.”

The Court of Appeal published their decision in this matter, which will be referred to when similar cases are presented before any California court. The case is: J.P. v. Carlsbad Unified School District.
